Important Notice

THIS IS NOT A MEDICAL DEVICE. POTS Check is a wellness application designed to help you track orthostatic vital signs at home. It is not intended to diagnose, treat, cure, or prevent any disease or medical condition.

By using this application, you acknowledge and agree to the following terms and conditions.

1. Acceptance of Terms

By accessing or using POTS Check ("the App"), you agree to be bound by these Terms of Use. If you do not agree to these terms, you must not use the App.

These Terms constitute a legal agreement between you and Cascade Agentic Labs LLC ("we," "us," or "our"). Your continued use of the App indicates your acceptance of these Terms and any updates.

2. Medical Disclaimer

2.1 Not a Diagnostic Tool

The App is not a medical device and is not FDA-cleared or approved for any medical purpose. The App:

Does NOT diagnose any medical condition, including POTS
Does NOT replace professional medical advice, diagnosis, or treatment
Should NOT be used to make medical decisions
Is NOT intended for emergency use

2.2 Consult a Healthcare Provider

Always consult with a qualified healthcare provider before:

Starting any new health monitoring routine
Making decisions about your health
Changing your medical treatment
Using test results for any medical purpose

Emergency Notice

If you experience severe symptoms during or after testing (severe dizziness, chest pain, shortness of breath, fainting), seek immediate medical attention. Call emergency services (911 in the US) if needed.

3. Intended Use

The App is intended for personal wellness tracking only by individuals who:

Are at least 13 years of age
Do not have known serious cardiovascular conditions (unless cleared by a physician)
Understand this is not a medical device
Use the App for informational and educational purposes only

3.1 Wellness, Not Clinical Data

POTS Check generates consumer wellness data, not clinical-grade medical data. Test results are:

Approximations based on consumer-grade sensors (Apple Watch)
Subject to environmental and physiological variability
For informational and educational use only
Not suitable for making medical diagnoses or treatment decisions

4. Your Responsibilities

4.1 Safety First

You agree to:

Stop testing immediately if you feel faint, dizzy, or unwell
Follow all safety instructions provided in the App
Have a safe environment for testing (wall support, ability to sit/lie down quickly)
Not drive or operate machinery immediately after testing if you feel symptoms
Inform your healthcare provider about your test results if discussing symptoms

4.2 Data Accuracy and Sensor Limitations

Important Sensor Limitations

You acknowledge and understand that:

Apple Watch is NOT FDA-cleared for medical-grade heart rate monitoring
Heart rate accuracy varies based on skin tone, tattoos, wrist movement, ambient temperature, and individual physiology
Optical heart rate sensors may be less accurate during rapid heart rate changes
Motion artifacts can significantly affect readings during position transitions

4.3 Age Requirements and Parental Consent

Minimum Age: Users must be at least 13 years of age (COPPA compliance)
Ages 13-17: Parental or guardian consent required
Under 13: App cannot be used

5. Data Collection and Privacy

For detailed information about how we collect, use, and protect your health data, please review our comprehensive Privacy Policy.

5.1 What We Collect

Heart rate data from Apple Watch (via HealthKit)
Blood pressure data (if you manually enter it during testing)
Test timestamps, durations, and results
Symptom logs (if you record them)
Motion and posture data (via Core Motion framework)

5.2 We Will NEVER

Sell your health data to third parties
Use your HealthKit data for advertising
Share your data with data brokers
Transmit your unencrypted health data to third-party servers

6. HealthKit Data Usage

6.1 Required Permissions

Heart Rate (READ access) — Required for test execution
Workout Sessions (WRITE access) — Required for continuous heart rate monitoring

6.2 Optional Permissions (Secure Account Only)

For Health Profile import:

Blood Pressure, Heart Rate Variability, Resting Heart Rate, Walking Heart Rate, Respiratory Rate

Note: Blood pressure must be entered manually during tests. Apple Watch does not measure blood pressure.

6.3 HealthKit Policy

In compliance with Apple's HealthKit policy:

HealthKit data is used solely for app functionality
HealthKit data is not shared with third parties
HealthKit data is not used for advertising
HealthKit data is encrypted on your device

7. Limitations of Liability

7.1 No Medical Liability

To the fullest extent permitted by law:

The App developers are not liable for any medical outcomes resulting from use of the App
You use the App at your own risk
The App is provided "as is" without warranties of any kind

7.2 Disclaimer of Warranties

We make no warranties that:

The App will be error-free or uninterrupted
Test results will be accurate or reliable
The App will meet your specific needs
Any defects will be corrected

7.3 Limitation of Damages

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, in no event shall the App developers (Cascade Agentic Labs LLC) be liable for any indirect, incidental, special, consequential, or punitive damages.

Monetary Cap: Our total aggregate liability shall not exceed the greater of: (a) the amount you paid for the App in the 12 months preceding the claim, or (b) $100 USD.

8. Intellectual Property

8.1 App Ownership

The App, including all content, features, and functionality, is owned by Cascade Agentic Labs LLC and protected by copyright, trademark, and other intellectual property laws.

8.2 Your Data Ownership

You own your test data. The App does not claim any ownership rights over the health data you generate. Your data belongs to you, and you control how it is used and shared.

8.3 License to Use

Subject to your compliance with these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to use the App for personal, non-commercial purposes.

9. Changes to Terms

We may update these Terms of Use from time to time. We will notify you of significant changes by displaying a notice in the App and requiring you to re-accept updated terms.

Continued use of the App after changes constitutes acceptance of the new terms.

10. Governing Law and Jurisdiction

These Terms are governed by and construed in accordance with the laws of the State of Washington and the United States, without giving effect to any principles of conflicts of law.

Jurisdiction: You agree that any legal action shall be brought exclusively in the state or federal courts located in King County, Washington.

11. Apple App Store Terms

You acknowledge and agree that:

These Terms are between you and Cascade Agentic Labs LLC only, not with Apple Inc.
Apple has no obligation to provide maintenance or support for the App
Apple is not responsible for the App or any content within it
Apple and its subsidiaries are third-party beneficiaries of these Terms

13. Severability

If any provision of these Terms is found to be unenforceable, the remaining provisions will remain in full force and effect.

When you accept these Terms of Use in the POTS Check app, you confirm that you have read, understood, and agree to be bound by all terms and conditions contained herein.
